Based on an in-depth understanding of insolvency laws, procedures and processes, Marccus Partners is able to deliver tailor-made solutions for its clients underpinned by expert advice from a number of disciplines across the firm such as labour, corporate, finance, capital markets and tax law.


Representing Stakeholders in Solvency Situations -Top-

Marccus Partners develops strategies to resolve difficult situations and complex problems by advising debtors, management, banks, investment funds, bondholders and other stakeholders before and during insolvency. Depending on the jurisdiction, we assume either the role of receiver, of advisor to the receiver or of advisor to other stakeholders. We represent creditors and debtors in complex commercial disputes involving insolvency issues, both out of court and before the bankruptcy courts. We also assist clients in connection with allegations of financial fraud or mismanagement and lender liability claims.


Acquisition of Distressed Assets -Top-

For investors, we analyse the risk of acquiring distressed assets and perform due diligence work, particularly in order to minimise the risks associated with conflicting rights of other creditors and stakeholders in case of bankruptcy/insolvency proceedings. We design strategies in order to ensure the smooth takeover of corporate assets, debt portfolios or bonds, and handle negotiations with all parties to such transactions as well as filings and permit requirements vis-Ă -vis public authorities and courts.


Workout -Top-

After acquiring a real estate portfolio or debt portfolio, investors need advice on insolvent asset workouts. We provide the buyer with a workout plan, a detailed cash-flow plan and an analysis of a refinancing plan throughout the investment period. Furthermore, we assist and represent our clients in negotiations concerning the disposal of assets, settlement of debts, forced sale of collateral, auctions in court and negotiations with banks.
