Marccus Partners’ dispute resolution practice covers the whole spectrum of litigation, from traditional litigation through to arbitration and mediation as well as other forms of alternative dispute resolution in both domestic and international matters.

Litigation in Ordinary Courts -Top-

clients are major multinationals, medium-sized companies and financial institutions as well as governments and European institutions. We represent our clients in a wide range of complex commercial, labour and tax disputes involving multiple claims and parties before the various tribunals and courts. We advise them on the courses of action best suited to achieve their legal and business goals. To this end, we work together closely with our clients to elaborate and implement the best litigation strategies, assess litigation risks and propose preventive action such as conciliation, mediation, med-arb, mini-trials or dispute boards. During the dispute resolution process we are proactive and determined, but nonetheless very sensitive to the benefits of amicable dispute resolution and the preservation of ongoing commercial relationships whenever this is possible.

 Our lawyers are experts both in finding creative and practical solutions and in maintaining control over legal disputes and the associated costs. We can provide either a standardised or a tailor-made approach, depending on the needs and focus of the individual client. In complex cases our clients make use of our ability to call in financial experts from Mazars or technical experts for other areas or jurisdictions and to coordinate the advice.

 Our international team of lawyers is accustomed to conducting proceedings in the local language of the court and to preparing reports and providing strategic advice in the language of the client. We are familiar with the issues associated with choice of law, forum election, comparative and foreign law as well as with cross-cultural issues, and are thus able to adopt the litigation strategy best suited to our clients’ requirements.

Arbitration issues are often cross-cultural and call for bespoke advice. Arbitration allows business disputes to be resolved in a timely and cost-efficient manner through expert decisions by professional arbitrators.Arbitration also has the advantage of allowing parties to be represented by their usual attorneys and trusted advisors, irrespective of the place where the proceedings are held.

We have extensive experience in international and domestic arbitration, both concerning institutional rules and in ad hoc proceedings.

 We can act either as arbitrators in the hearing and resolution of matters in arbitral tribunals or as counsel to our clients at all stages of the arbitration process, be it in the drafting of arbitration agreements, holding of pre-litigation negotiations, elaboration of litigation strategies, representation of clients during the arbitral proceedings or in the use of domestic courts to assist our clients in the arbitral proceedings and to secure recognition and enforcement of the final award.
